Court Refers NRM Disqualified Candidates’ Case

The defense side in case where fourteen people are accused of attacking Kabamba barracks before Makindye General Court Martial has asked court to disregard or impeach the testimony of Norman Sembatya, tadalafil a prosecution witness they consider a criminal whose evidence cannot be relied on by court.

Lead Defense counsel Jude Mbabaali filed an application with facts that Norman Sembatya is a robber who was arrested in a bank robbery of 400 million shillings while using one of the vehicles belonging to the accused persons which leaves them wondering how such a person’s testimony can be based on.

In their submission Defense point out the Evidence Act Section 154 (a),(b),(c) which prohibits criminals or people with bad reputation from being used as witnesses in court matters

Mbabaali thus asked court to impeach Sembatya’s evidence saying that (one of the accused) Private Sekajja Keneth’s vehicle Ipsum registration number UAN 433L  in which Semabatya was arrested during the robbery mission was stolen from him in May 2015.

A total of 14 people are accused in this case of consciously omitting to disclose vital information to the army authorities about the recruitment of people to engage into activities intended to prejudice security of defense forces with the preparation to attack an Armored warfare training school in Kabamba.

High court in Kabale has referred for mediation the case in which four members of NRM in Kanungu district were disqualified from competing for positions in NRM internal party elections on allegations that they are Amama Mbabazi supporters.

Justice Michael Elubu made the decision on Tuesday before appointing counsel Ezra Bikangiso to mediate the two sides.

The complainants are Zepher Mugisha  who was running for mayor  Kihihi  town council , clinic Allen Atuhaire for district woman councilor Kihihi town council, page Kenneth Tumuhamye for  LC3 Chairperson  Kanyantorogo sub county   and Nelson Natukunda  LC3 chairperson for  Kihihi sub county.

These were disqualified from the elections on October 5, 2015 by the Kanungu NRM registrar John Byaruhanga under the orders of Kanungu RDC Harriet Nakamya over alleged ties with the former Prime Minister and now presidential candidate John Patrick Amama Mbabazi.

Elubu said that the hearing of the case couldn’t proceed because it was still premature and new judicial laws require that under such circumstances, mediation must be allowed first.

He then appointed counsel Ezra Bikangiso to mediate between the two sides and adjourned the case till December 16 2015.

Earlier, there was drama when the file of the case first went missing and the case had to wait for about an hour.
