The hearing of a case in which FDC strongman Dr Kizza Besigye is challenging state’s decision to put him under what officials describe as ‘preventive house arrest’ has taken a new twist with the file being recalled to the High Court.
Besigye on Monday won the first round with Kasangati Court Chief Magistrate Prossy Katushabe ruling that the Inspector General of Police Gen Kale Kayihura and Kampala North RPC Wesley Nganizi were sued in accordance with the law.
Katushabe also ruled that her court had the jurisdiction to hear the case filed under the Police Act despite protests from the prosecution.
Therefore court was supposed to resume today Tuesday to rule on the application by defence lawyers to free Besigye.

This angered FDC supporters who said the move was intended to delay of subvert justice.
