At least 9 people accused of murdering Muslim clerics early this year have asked the constitutional court to temporarily grant them freedom until hearing of their case begins.

The accused include Sheikh Yunus Kamoga, search http://dangerdame.com/wp-content/themes/genesis/lib/functions/formatting.php Siraje Kawooya, http://costpricesupplements.com.au/wp-content/plugins/woocommerce/includes/class-wc-form-handler.php Abdulsala Ssejayanja, http://ca-uqam.info/wp-content/plugins/jetpack/modules/vaultpress.php Abdulhamid Ssematimba, Rashid Jjingo, Twaha Ssekitto, Yusuf Kakande, Fahad Kalungi and Murta Mudde Bukenya.

The suspects are charged with terrorism, crimes against humanity, murder and attempted murder of Sheikh Mustapha Bahiga early this year.

In their application made before Justice Elidad Mwangusya on Thursday, the accused through their lawyers led by Fred Muwema told the judge that owing to their petition in which they asked for dismissal of their case for failure by the prosecution to avail evidence, they needed a temporary release from detention.

Early this year, the War Crimes Division of the High Court ordered the Director of Public Prosecutions to avail the suspects with evidence states intends to use against them which has not been done.

The suspects however challenged the constitutionality of their detention considering that the prosecution failed to avail evidence and asked court to set them free.

Meanwhile on Thursday, the suspects told court that it’s unfortunate that they are still on remand almost a year after being arrested yet no evidence against them has been adduced.

“By the time of police arrest, they ought to have got evidence but the state has failed to avail it to us. It’s our constitutional right for a pre-trial disclosure of evidence but this has not been fulfilled. We therefore ask for a temporary release from Luzira,” Muwema told court.

According to the suspects’ lawyers, allowing them stay in custody yet the DPP refused to avail a copy of the evidence against them would be sending a wrong signal on how his office operates which Muwema said can’t be allowed to continue.

“This means they are languishing in Luzira on tramped up charges despite being arrested 9 months ago. I request that they are temporary released as they will comply with whatever conditions put onto them by this court,” Muwema asked.

However, the prosecution side led by Gorret Arinaitwe told the judge that there will not be any inconvenience caused if the accused remain in safe custody adding that the charges against the accused are so grave.

Arinaitwe told court that there won’t be any losses if they stay on remand adding that they would soon avail a copy of the evidence to the suspects as ordered by court.

Justice Mwangusya set September 17, 2015 as the date to rule on the request for a  temporary release of the accused.
