Pastor Petitions Principle Judge Over ‘Biased’ Buganda Road Magistrate

Pastor Deo Semakula, discount who is accusing the Former Kawempe Division Mayor Hajji Nasser Takuba alongside Valentino Kajungu a city businessman, of forging a certificate of title of his land, has decided to refer the matter to the Principal Judge Yorokamu Bamwine.

This is after he developed suspicion that the trial magistrate at the Buganda Road Court could frustrate his case.

Pastor Deo Semakula first lodged a complaint to the Chief Registrar of courts Paul Gadenya on grounds that he had lost trust in the Buganda Road Magistrate Jamson Karemani.

In his compliant to the Registrar dated December 1st, 2016, Pastor Semakula pointed out that he didn’t expect justice because the magistrate was friends with the defense lawyer Chris Bakizza, which he established himself.

He says he was suspicious when the magistrate rejected the tendering of important exhibits in form of documents for unclear reasons.

“At first I brought the Lands Registrar on 14th April 2016 to tender in the forged documents but the magistrate refused them, stressing that I had to bring the receptionist who stamped them. Later on 24th October 2016 I brought the receptionist but still he declined to accept them,’ he said.

The pastor told the Chief Registrar that since the two rejected witnesses were the only people to
testify against the accused, it meant that he could not get justice.

Later after the prosecutor on the case decided to quit it because of being frustrated by the magistrate, the pastor decided to request the registrar to transfer this file to another magistrate.

In a letter dated January 11, 2017 the Chief Registrar Paul Gadenya advised Pastor Deo to appeal against the magistrate’s actions at the end of the trial.

But the pastor was not convinced with this advice and thus decided to refer the matter to the Principle Judge Yorakamu Bamwine.

On his part, Chief Magistrate Jamson Karemani advised Pastor Deo to always consult lawyers in all matters of the law to avoid making mistakes.

Karemani added that for all the 15years he has spent in the judiciary, his has executed his duties with guidance from God.

Although the defense counsel Asuman Basalirwa had asked for the case to be dismissed, the magistrate has adjourned the hearing of the case as they await the Principle Judge’s decision.
