Three Justices of the Court of Appeal have upheld the decision of Soroti High Court Judge Justice Billy Kaimemura that nullified the election of Christine Tubo Nakwang as Kabong District Woman MP
The decision was based on evidence that Tubo bribed her way to parliament with money and alcohol.
The three Judges Kenneth Kakuru, medicine Alfonse Owiny Dollo and Richard Buteera in their judgement concurred with Justice Kainamura that she properly evaluated the evidence on bribery allegations and therefore reached a fair conclusion
These went ahead and declared the Kabong woman MP seat vacant, thereby ordering Electoral Commission to organize fresh elections.
In her petition, Lily Rose Akello accused the incumbent Tubo of bribing voters of Kathile Trading Centre, Kathile West, Namamutau and Nikwapicha villages on the eve of the 18/February/2016 polls.
The Appellant Court judges ordered the Electoral Commission and Tubo to pay the costs for this matter at both levels.
