Kabaziguruka Bail Flops as DPP Refuses to Participate

Hearing of Nakawa Municipality MP Hon Michael Kabaziguruka’s bail today failed to commence after the state prosecution informed court that they were not ready for the hearing, approved http://curcumincapsules.art14london.com/wp-admin/includes/nav-menu.php which had been fixed to start today before Justice Yasin Nyanzi.

Kabaziguruka through his lawyers led by Ladslaus Rwakafuuzi had prepared to file a bail application but their efforts were futile after senior state attorney Wanamama Isaiah informed court that he had instructions from the DPP not to proceed with this matter; and asked for an adjournment.

Prior to this, http://cheapcouriercomparison.com.au/wp-content/plugins/jetpack/uninstall.php the State Attorney stated in court that the DPP could not participate in a matter that is before the General Court Martial, on whose orders the MP was sent on remand.

“The DPP has declined participating in this matter basing on Article 123 of the constitution which restricts him from involving himself in matters before a military court,” Wanamama submitted.

However, the applicant’s counsel Rwadslaus Rwakafuuzi opposed this claim, stressing that the State had never made any submissions that they can’t participate in matters before court martial

“The bail application is not before the General Court Martial and nobody has asked him to go there but this is a matter before the High Court” Rwakafuzi submitted.

He added that in one week’s time they are going to serve the three prosecution organs of the government, that is the General Court Martial’s Prosecution Section, the Attorney General and the DPP, to select from themselves who is to appear in court over this matter.

Justice Yasin Nyanzi adjourned this matter to 20th October for hearing as Hon Kabaziguruka was further remanded until then.
