Delivering her ruling recently in a civil suit number 136 filed by Ntwatwa in March 2014, her Lordship Hon. Lady Justice Henrietta Wolayo ruled that the preliminary objection of a suit against Major General Kainerugaba, the OC CID Kampala, Frank Ataho, Eric Kagina and police officers Asiimwe (no.43966) and Wasike (no.12986) attached to the Central Police Station be upheld.
However, in the same ruling, the lady Justice also directed that the suit against the Attorney General (as the representative of Government), AYA Investments LTD, and two staff working with the AYA Group, Mohamed Hamid Latif and Watuwa Mustafa would proceed.
Major General Muhoozi Kainerugaba was represented by prominent city lawyers Edwin Karugire and Kiryowa Kiwanuka of Kiryowa and Karugire Advocates.
In April 2008 while employed as a casual labourer (carpenter) by AYA Group at the Hilton Hotel construction site in Nakasero, Ntwatwa’s left hand was seriously injured by a falling slab board, sending him out of work indefinitely.
Ntwatwa later filed a suit in the Chief Magistrates Court Mengo seeking compensation, general damages, interest and costs of the suit.
Ntwatwa was later through a court order compensated with Shs 37m for his ordeal.
It is however unclear how the Special Forces Chief came to be dragged into the matter.
Ntwatwa claims that while going to AYA Hilton Hotel to demand for his payments, he was kidnapped and tortured by SFC operatives manning the Hotel.
The hotel towers are adjacent to the nearby Nakasero State lodge. The Special Forces Command vehemently denied Ntwatwa’s allegations.
