Former RDC Fined Shs50M For Humiliating Doctor

Kangonge Kambarage, the former RDC Kabarole has been fined Shs. 50Million by Fort Portal High Court for humiliating Dr. Ephraim Basaliza in public.

Kambarage now working as Commissioner National Guidance appeared before the Fort Portal High court presided over by Justice Oyuko Anthony Ojok on Tuesday afternoon.

Prosecution told court that on 19th August 2009 at a meeting of the District Agriculture Advisory Services at McCauley Social Hall Virika, Kakonge Kambarage the then RDC Kabarole directed  52-year-old Dr. Ephraim Basaliza, a Senior Veterinary Doctor in Kabarole district to kneel down on the floor in front of his colleagues as a punishment.

Dr. Basaliza was embarrassed during a meeting of agriculturalists after he refused to obey a directive by the RDC to tell on Peter Bacwa, who was talking on phone outside the meeting hall to keep quiet.

Court heard that Kambarage Kakonge shouted at Basaliza and ordered him to kneel down in front of the room saying that by disobeying him, the vet doctor had directly disobeyed President Yoweri Museveni because he was his representative in the district. The respectful vet doctor knelt down and spent 10 minutes before retaining his seat.

Dr. Ephraim Basaliza dragged RDC Kambarage to the Uganda Human Rights Commission and Fort Portal high court seeking punishment and damage compensation for violation of human rights, humiliation and belittling in the presence of his colleagues.

In his judgement, judge Oyuko Anthony Ojok said the action of the RDC to order Dr.Basaliza to kneel down in public  constitutes torture, cruelty, inhuman, degrading treatment, illegal, unconstitutional and  contravenes  Articles 20,24 and 25 of the constitution of Uganda and Sec 71 of the Local Government Act Cap 243.

He therefore ordered RDC Kakonge to compensate the applicant with shs30m in general and shs20m in damages for the inhuman treatment, torture, embarrassment, humiliation and pain subjected to the applicant.

The Furious judge ruled that a disciplinary action should be taken against Kakonge Kambarage if he is still RDC but if not, he should never be appointed again in any Government Institution in any position.
