Ex Air Force Commander Floors Fellow Army Officer In Land Case

Lt. Gen. Jim Besigye Owoyesigire the former UPDF’s Air Force Commander has defeated a fellow army officer in a land case they were involved in at the Kabale High Court since 2014.

Lt. Owoyesigire in 2014 sued the former head of discipline in the Internal Security Organization (ISO) Lt. (Rtd) Mohammed Bahati Kabahena over malicious damage and criminal trespass.

Owoyesigire dragged Lt. Lt. Kabahena had claimed ownership of the same piece of land and that Gen. Owoyesigire was trying to grab it using a forged land title.

The former claimed he bought the land from one Tadeo Karekyezi on 24th April 2013 at Shs. 40 million.

General Owoyesigire on the other hand told Court that he bought the plot from one Hilary Musinguzi in 2010, who had earlier acquired it from the Tadeo Karekyezi in 2004.

Justice Moses Kawumi Kazibwe in the judgment on Wednesday ruled that Lt. Kabahena failed to prove that the plot of land belonged to him, and that all the witness that he brought never proved the same.

The judge thus issued a permanent injunction restraining Lt. Kabahena and his agents against further trespass on the land in contention.

He also ordered Lt. Kabahena to pay 20 million shillings as general damages to his accuser and 2 million shillings as special damages and costs.
