Justice Michael Elubu, while delivering his judgment said that the Principal Javan Rwanyanure Lwamafa contravened the Education Act (2008).
He noted that while Regulation 21(b) of the third schedule of the Act hands the Principle powers to exercise the functions of the board delegated to him; there was no evidence that this power was actually delegated to the principal by the board.
“Therefore the procedural requirement of the legislation was not followed as the principal was under the legal obligation to immediately report the suspension to the board which he did not do,” ruled the Justice.
Justice Elubu ordered the decision of the College Principal Javan Lwamafa to be quashed.
In 2014, Rogers Mehangane through his lawyers of Wilfred Murumba and Matsiko Advocates went to the court seeking judicial review of the decision taken by the college principal to suspend him indefinitely for impregnating a fellow student.
The Court ruled that the decision taken by the principal disregarded the rules of natural justice as Mehangane was not given a fair hearing, since the board never sat to hear from him.
The court however, did not award him damages noting that the while he was suspended illegally, the Principle was only trying to enforce discipline in the institution.

It is understood Besigye made his presentation to the TDA and that Mbabazi had followed suit.
TDA spokesperson Hon Wafula Oguttu has since urged patience, assuring the country that the joint candidate would be unveiled by Wednesday.

Kakungulu said prayers at the National Mosque will commence at exactly 9:00am and that vehicles would not be allowed inside the Mosque perimeter.
Muslims were advised to adhere to all security arrangements.
