Waliggo told Chimpreports on Tuesday that she has ordered her lawyers led by David Tebusweke Mayinja to file an appeal against the judgment that was given on Monday 27, June at the Masaka High Court.
Waliggo filed a case praying that Court nullifies the election of Aisha Sekindi for the position on grounds that she never had the academic qualifications required for the contest.
The DP candidate argued that the Uganda Certificate of Education, the Grade III Teachers and National Council of Higher Education certificates that Sekindi presented at nomination were all fake.
“We find it irregular that the judge shifted the burden of proof of whether Sekindi’s academic qualifications were genuine from the respondents to the petitioner,” Waliggo said.
Waliggo noted that after a search of results from UNEB it revealed that there was no student/ candidate by names of Aisha Sekindi who sat for Primary Leaving Examinations (PLE) at the school in 1984.
Waliggo argued that Sekindi did not produce a valid certificate of equivalence from the National Council for Higher Education (NCHE) at the time of her nomination as the one she produced was signed by the Executive Director instead of the Executive Secretary.
“We find that the decision was made on political consideration and not the law that is why I have instructed my lawyers to launch a stay of execution so as to nullify the ruling.”
