Court Orders Media Houses to Stop Publishing Kaweesi Murder Stories

The High Court in Kampala has today Friday issued an interim order stopping a group of media houses from publishing stories related to the Kaweesi murder investigations.

The Inspector General of Police, Gen. Kale Kayihura on Thursday sued 4 media houses including ChimpReports, The Investigator, Red Pepper Publications and The Ugandan for publishing what was termed as series related to the investigation of  the murder of  former police spokesperson  AIGP Andrew Felix Kaweesi.

In his affidavit, Kayihura said that the publications are a threat to the ‘delicate’ investigations of the high profile case being carried out by the police force.

“The respondents’ publications about the death and investigations of the late Andrew Kaweesi  case contain confidential information  which will jeopardize investigations,” said Kayihura in his affidavit before asking for an interim order stopping the publications.

However on Friday morning, High Court Registrar  Joy Kabagye  heard an exparte application where only the Attorney General was represented by  Geoffrey Madete before  granting the order.

“An interim order doth restraining the respondents by themselves or through their authorized agents and employees from publishing contents or running series on the investigation into the murder of AIGP Andrew Felix Kaweesi pending  the disposal of the main application,” read the order signed by  Deputy Registrar.

This investigative website has also learnt that the main suit will be heard by Justice Steven Musota on August 21,2017.

    I wonder whether this injunction covers stories about police brutality in relation to the investigation into the murder. There is already such an allegation about the Mayor of Kamwegye. Does it cover pronouncements on the murder investigations by M7 or will the media houses be in contempt of court if they report on his pronouncements?
    My short point is did the Judge properly exercise her mind as to the knock on effect or unintended consequences of this injunction? I can see a situation where the editors of these media houses could be hauled before the court on contempt of court charges based on stories they publish that might be construed to have a connection to the investigation, however tenuous this might be. I think justice requires that this injunction is challenged otherwise it gives the police yet another tool to stifle freedom of speech and public discourse on a matter that is of great public interest as it involves a vital organ of the state, the police, who incidentally (in the eyes of the public) are in the frame as potential suspects. The judge is virtually allowing the police to suppress evidence if it points directly at itself. Where is the justice in an order which has such an effect?
