Court Opens Besigye’s Defamation Case for Hearing After Failed Talks

City business man Muhammad Sebuufu who is charged with four others for murdering Donah Katushabe was unable to appear before Buganda Road Chief Magistrate Flavia Nabakooza due to his deteriorating health condition.

Sebuufu was this morning brought from Luzira in a Prisons Double cabin truck together with his co-accused, there http://dcdal.org/components/com_k2/k2.php but could not attend the court session.

The prisoner warders kept him in back of the car, here saying that he was too weak to walk out.

In court the Magistrate was on asking, was informed by Sebuufu’s lawyer Isaac Walukaga that the accused was too feeble to make it to the dock.

State Prosecutor Jonathan Nuwaganya informed court that the Police file for this case was not in court and investigations were incomplete thereby requested for an adjournment.

The magistrate adjourned the case to 23rd December 2015 warning the Prisons officers that next time they appear in court without the accused, they should at least carry a medical document to that effect.

Prosecution alleges that on 20th March 2015 Muhamad  Ssebufu, Tasingika , Godfrey kayiza, Phillip Mirambe and Stephen Lwanga  used sticks and a machete to beat and hack Katushabe to death for failure to clear a 9 million shillings debt which was balance for a  car that she had  bought from them.

This came after the plaintiff Col Ndahura Atwoki Biraku though his lawyers of Kafeero and company advocates failed to reach an agreement with the defense side outside court.

This is the second time that both parties have failed to reach an out of court settlement.

Col. Ndahura alleges that Besigye uttered defamatory statements in 2012, http://clearskinconcierge.com/acne/wp-includes/class-wp-site.php accusing   him of murdering one Johnson Baronda in Rukungiri District during the 2006 general elections, thus leading to his promotion.

Ndahura in a suit filed in 2012, accuses Dr. Besigye of giving an interview to The Observer, accusing him of murdering Johnson Baronda on government orders. Besigye also said in the interview that Col. Ndahura had been promoted from Lieutenant Colonel after he fulfilled the mission.

Baronda who was aged 47 at the time of his death, was allegedly caught in gunfire as a squad of the the then Presidential Protection Unit [PPU] assaulted Dr Besigye’s rally in Rukungiri town.

Hearing of the case will now proceed, presided over by Justice Stephen Musota.

Dr. Besigye says he cannot retract his statement about the murder and promotion of the officer.

Ndahura on the other hand insists the comments uttered by Dr Besigye were false, defamatory and libelous, for which he is claiming damages.

He further claims that the statements have caused him ridicule, hatred and that his reputation has been lowered in the eyes of the right thinking members of society.

Dr. Besigye in his defense claims the interview was published in public interest, and that it was not intended to ridicule Ndahura as purported.
