The High Court in Kampala has upheld the decision by the Makerere University Elections Tribunal to hold fresh guild elections at the School of Education.
Justice Stephen Musota on Thursday dismissed with costs an application filed by the Makerere guild-President elect Bazil Biddemu Mwotta in which he sought to halt the fresh election. He also wanted court to declare him the overall winner of the March 2016 election and duly elected guild president.
In this application Mwotta had sued his opponent Roy Ssembogga and the university’s Elections tribunal for taking the decision to hold fresh elections at the University School of Education without first giving him a fair hearing; which he says had an impact on his victory
Justice Musota in his ruling pointed out that there was sufficient evidence on court record showing that both Mwotta and Ssembogga were accorded equal opportunities before the tribunal to state their complaints and defenses before reaching the decision.
The judge has further expressed dismay for Mwotta’s conduct to turn around and say he was never heard by the tribunal
