Court of Appeal has upheld held Joseph Kakooza as the legally elected MP for Buwekula constituency in Mubende District
The three judges of the court Richard Buteera, pharm Elizabeth Musoke and Paul Mugamba today dismissed the appeal filed by Kakooza’s political rival Peter Baleke, advice who dragged him to Mubende High Court accusing him of forging academic papers, cure which petition was dismissed by the high court before he appealed.
Baleke had claimed that Kakooza forged a certificate from the Tanzanian Military Academy of Monduli. The certificate had the names of Kakooza J S which he said could have applied to a different person.
This is the Certificate on which National Council for High Education based to verify MP Kakooza’s academic papers both in 2010 and 2015 for the parliamentary race.
In their judgement, the three judges said they found no merit in Baleke’s argument because he never proved to court how he arrived at the said conclusion; neither did he bring persons claiming to be Kakooza J S to testify in support of his claims allegations.
The judges also considered the affidavits of two UPDF officers Brig Byarugaba Jim Willis and Gen Pecos Kuteesa who pointed out that they studied Kakooza at the Military Academy and that they used to refer to him as Kakooza Joseph Smarts.
Baleke was thereby ordered to pay costs to MP Kakooza, which he incurred both in this court and the Mubende High Court.
