FDC Former Presidential Candidate Col Dr Kizza Besigye had been granted bail from Luzira Prison by the Kampala High Court.
Besigye who has been on remand since May on Treason charges was handed the temporary freedom by Justice of Musalu Musene of the High Court.
He was released on a none-cash bail of Shs. 100million and a Shs. 100million for each of the four sureties; Maj. Gen. Justice Museni found these sureties credible. He also noted that Dr Besigye has never been convicted of any case and has never jumped bail.
The Prosecution side had yesterday opposed Besigye’s bail on grounds that his “advanced” age could not be proven.
The prosecutors Brian Kalinaki and Florence Akello also told court that Besigye was arrested for treason charges; an offence that carries a maximum (death) sentence.
“He was a former leader of FDC party and a presidential candidate. He is a political leader with high influence and if released on bail, decease he might interfere with investigations because of having a big number of followers,” Akello argued.
This morning however, Justice Musene dismissed all the grounds fronted by Prosecution challenging the release of Besigye, and insisted that the accused had every right to be granted the constitutional freedom.
Court attendants majorly supporters of the former candidate broke into ecstatic celebrations as the judge pronounced himself.
In his ruling, the Judge ordered Dr. Besigye to report to court every two weeks. Besigye was also cautioned against use of violence through his trial.
