Army Court Issues Criminal Summons for MP Kabaziguruka

The Makindye General Court martial has issued criminal summons for Nakawa Municipality legislator Michael Kabaziguruka for skipping court.

Kabaziguruka is said to have missed court on two occasions for mention of the case where he is accused of Treachery alongside others including UPDF officers.

The Court Martial Registrar Major John Bizimana told court today that on Friday last week, viagra buy he called Hon Kabaziguruka informing him about this week’s sitting, information pills but that the MP told him that he was advised by his lawyers not to return to this court until the matter before constitutional court where he challenges the army court’s powers to try civilians, view is disposed of.

The Registrar was thus ordered by the court to write to the Speaker of Parliament Rebecca Kadaga to compel Hon Kabaziguruka to appear in court.

In November last year, MP Kabaziguruka through his lawyers of Lukwago and Co. Advocates petitioned the Constitutional Court seeking a declaration that the General court martial and other military courts are unconstitutionally established.

The Nakawa MP pointed out that he complained about the powers of the court martial to try civilians but the officers sitting on panel insisted that they had powers to try anybody with a criminal offence.

In his application, the MP wants the army courts’ powers limited to only disciplining soldiers rather than charging them and civilians with any other offences.

Kabaziguruka in his petition further accuses the 6th Parliament of over stepping its powers by creating section 197 of the UPDF Act that establishes  the General Court Martial other than a mere tribunal to instill  discipline among  UPDF soldiers.

He now wants the Constitutional Court to suspend the trial against him and his co-accused and at the same time for the court to issue an order barring the court martial from further trying of any other capital offence.

After filing this application, he applied and was released on bail by High Court judge Yasin Nyanzi from Kigo prison where he had spent months on remand

Prosecution at Makindye General Court martial alleges that between February and June this year, Kabaziguruka and 26 others including UPDF soldiers plotted in Kampala, Wakiso and Luweero districts, to overthrow the government by force of arms.
