But prosecutor Sydney Asubo disputed this, insisting ministers are government officials.
While Mpanga argued there was no other evidence apart from signed vouchers implicating Mukula, Asubo said he presented to court other pieces of evidence showing Mukula “kept the money in a safe place for nine months.”
Mukula did not reveal the “safe place” and only returned Shs54m.
Asubo opposed the appeal before requesting the judge to uphold Mukula’s conviction.
Interestingly, Justice David Wangutusi tasked the state prosecutor to give out reasons why Mukula was charged of embezzling only Shs 210 m yet he requisitioned Shs 236m.
Outside court, Mukula’s supporters loudly promised to continue “standing with the legislator during this difficult time.”
Court will give a ruling on Mukula’s fate on March 13.
